This policy (this “Privacy Policy”) outlines how Golden Shallot, LLC. (“Golden Shallot,” “we,” “us,” or “our”) collects and handles personal information from customers or visitors (“you,” “your”) on www.goldenshallot.com (the “Site”), or when you purchase or use our services (collectively, the “Services”).  By using our Services or providing us with your personal information, you agree to the terms of this Privacy Policy. If you do not agree with it, please refrain from using our Services or submitting your personal information. We recommend reviewing this Privacy Policy along with our Terms and Conditions and all other relevant privacy notices we may provide. This Privacy Policy does not apply to digital properties that do not link to this Privacy Policy or to third-party websites to which the Services may link to.

Personal information (refers to data that identifies you as an individual or relates to an identifiable person) that we may collect include:

Golden Shallot may engage third-party companies and individuals to perform various tasks on our behalf, and to provide products and services to you, we may need to share your information with them. These tasks include, but are not limited to, fulfilling orders, processing payments, handling billing disputes and collections, analyzing data, providing marketing assistance, informing you about products and services that may interest you from us or our partners, offering customer services, and conducting or gathering research related data. We may disclose your personal information to these entities as described below. Please note that such disclosure may occur based on your actions (e.g. using the Service or interacting with a social media widget. Data collected through the short code program will not be shared with third parties for their marketing purposes. This Privacy Policy does not apply to the practices of third parties that Golden Shallot does not own or control, or individuals that we do not employ or manage. You are subject to the privacy policies of those third parties. Golden Shallot is not responsible for the privacy or security practices of other websites, including those linked to or from our Services. We encourage you to review the privacy policy of any entity whose products or services you use through our Services.  We may share your information with the following types of third parties:

  • Third-party service providers who provide services such as website hosting, advertising technology services, payment processing (e.g., Stripe), order fulfillment & shipping providers (e.g. Dispatch), information technology and related infrastructure provision, customer support, analytics services, email delivery, auditing, and other services.
  • Third parties authorized by you.
  • Any surviving entity or successors-in-interest in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings) and, in each case, any due diligence relating thereto.
  • Business partners that display our ads on their digital properties, or to whose digital properties the Services link, including those partners that help us perform targeted advertising.
  • Advertisers and advertising networks to select and serve relevant adverts to you and others. The information shared may include device-level information and analytics.

  • As we believe necessary: (i) under applicable law; (ii) investigate or take action regarding illegal activities, suspected fraud, or violations of Golden Shallot's Terms of Use; (iii) to protect our rights, privacy, safety, or property, or the safety or property of yours or others; (iv) to allow us to pursue available remedies or limit our damages; and (v) to respond or comply with lawful requests from courts, law enforcement agencies, regulatory agencies, and other government authorities, which may include authorities outside your state or country of residence.

 

5. Marketing Communications
If you no longer wish to receive marketing emails, such as our product updates, promos, etc., you may opt out by following the instructions included in each email or by emailing your request to info@goldenshallot.com. Some communications from Golden Shallot, like order confirmations or correspondence with our support team, are related to the Services, and you cannot opt out of these emails. With your consent, we may send you SMS messages regarding your order or other relevant information. You may opt out of receiving SMS messages by replying “STOP” to the sender at any time. Please note that our partners, including shipping partners, may also contact you directly via SMS regarding your order. These messages are separate from any SMS messages sent by Golden Shallot.


6.Security
We take precautions to ensure that your information is handled securely and in compliance with this Privacy Policy. We also implement reasonable measures to protect your information from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction. For instance, we use network safeguards like firewalls, data encryption, Intrusion Detection Systems (IDS) and Intrusion Prevention Systems (IPS), enforce physical access controls, and grant access to personal data only to individuals who need to perform their job responsibilities. No method of transmission over the internet or electronic storage is entirely secure. You are responsible for keeping any passwords confidential and secure, including those used to access our Services, your email account, and your SMS destination. We recommend not to share any password with anyone else and not using it for other services or products. To the fullest extent permitted by applicable law, we are not liable for any unauthorized disclosure.


7. Persons Under 18 Years of Age
We do not intentionally collect personal information from children under the age of eighteen (18). If we become aware that we have collected such personal information, we will take appropriate steps to remove it from our database.


8. Digital Tracking Technologies
Golden Shallot utilizes various digital tracking technologies to better understand how users interact with our Services and to facilitate ad targeting by third parties for both first and third party products or services. We may partner with third-party services that use tracking technologies, such as browser cookies or Flash cookies, to provide certain services or features. These technologies allow our partners to recognize your computer each time you visit Golden Shallot.
If we use Google, Facebook, Instagram, or TikTok for advertising, please refer to their respective links to understand their opt-out options. Additionally, the online advertising industry offers websites where you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. You can learn more about targeted advertising, consumer choice and privacy by visiting the Network Advertising Initiative or the Digital Advertising Alliance.Keep in mind, you need to opt out separately for each browser and device,  if you clear cache or cookies, you’ll need to reset preferences accordingly. We are not responsible for any opt-out requests that are not honored by any advertising technology companies. Some web browsers also allow you to limit or disable the use of tracking technologies. 9. Deletion Requests
You may have the right to request the  deletion of certain personal information that we have collected and maintained about you, subject to certain exceptions. You can submit a deletion requests via email at info@goldenshallot.com. After we verify your request and determine that we are required to delete your information in accordance with applicable law, we will proceed with the deletion. Your request to delete your personal information may be denied if it is necessary for us to retain your information under one or more of the exceptions listed in the State Privacy Laws, or if we are otherwise legally required to retain your information (e.g., to comply with law enforcement or a court order). Please note that a record of your deletion request may be retained to meet our legal obligations.


10. Do Not Sell or Share My Personal Information
You may have the right to opt out of the “sale” and “sharing” of your personal information, as described above, including the use of your personal information for targeted advertising. If you would like to opt out of these uses of your personal information, you can submit a request to info@goldenshallot.com.

Any updates or changes to this Privacy Policy will be posted on this page, and when necessary, you may be notified via email, or through other methods deemed appropriate by Golden Shallot. Please check this page regularly for any updates or changes to this Privacy Policy. Your continued use of our Services after the posting of any changes constitutes your acceptance of the changes. The “Effective Date” at the top of this Privacy Policy indicates the date on which this Privacy Policy was last updated.
